RESOLUTION NO. 04-88

A RESOLUTION ADOPTING WATER AND

SEWER CONNECTION FEES

WHEREAS, the Council is required to set the connection fee schedule on an annual basis; and

WHEREAS, the Village of Taos Ski Valley is experiencing substantial residential and commercial growth in the community and there is a need to address the impacts of growth; and

WHEREAS, many future water and sewer capital infrastructure improvements will need to be completed as a result of growth in the community in order to maintain the current levels of service; and

WHEREAS, current residents have made substantial investments into our water and sewer collection and distribution systems; and

WHEREAS, current residents have made substantial investments into our water rights acquisitions; and

WHEREAS, whereas there is a need to provide an incentive for existing structure to connect; and

WHEREAS, Village Staff has calculated connection fees using empirical data from past studies and growth predictions for the future; and

WHEREAS, the Village Council chooses to impose connection fees to assist the Village in defraying the costs of new capital improvements driven by growth in the community.

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF TAOS SKI VALLEY THAT:

1. The Village of Taos Ski Valley has adopted the following Sewer and Water Connection Fee Schedule:

1.         Sewer Connection Fees shall be $1,778 for each bedroom in a home, condo, lodge or cabin. For all other uses, Staff shall estimate water usage and determine a corresponding connection fee.

2.        For all uses the minimum water connection fees shall be $666 with an additional $3,750 per single family residence of two bedrooms or less. Residences with more than two bedrooms shall pay $1,500 for each additional bedroom. Commercial connection fees shall be $2,250 per bedroom for condos, lodges, cabins and the like.

3.        For all other uses, including mixed residential/commercial developments, Staff shall estimate water usage and determine the corresponding additional fee.

4.        The additional water surcharge fees will be earmarked for future water rights acquisitions and transfers.

5.        If it appears to the Building Inspector, after the imposition of the connection fees, that the basis for the imposition of the connection fees has changed so that a greater amount of fees should have been imposed, the Building Inspector may impose the additional fees and place a lien on the property in that amount until the fees are paid.

6.         For all current residents of the Village of Taos Ski Valley who have paid or are currently paying for costs associated with the Village Interceptor Line, a credit of $2,000 will be applied to the sewer connection fee charge if the physical connection to the Village’s municipal sewer line occurs before October 1, 2005.

7. Commencing from the adoption date of this resolution, a thirty (30) day grace period shall be in effect whereby all current residents and businesses within 150 feet of a sewer main line shall be able to request connecting to the Village’s water and sewer utilities at the current rate of $666 per water and $666 per sewer by applying for said connection(s) and paying the appropriate connection fee. The Village will make the connection as soon as it is able in its sole discretion.
